Sauerbrun Contract Under Review

NFLPA challenging original contract
Punter's status remains in limbo

The National Football League Players Association is challenging the right of first refusal clause that the Patriots exercised to retain the punter.

This situation is different from the usual restricted free agency case. Sauerbrun's contract had a specific clause in it that allowed the Patriots a right of first refusal. The NFLPA is arguing that this clause was not filed correctly in the original contract.

If they had a problem with the clause...
...why didn't they challenge it when the contract was originally signed?

Good Question
I thought every contract was filed with the league office and the NFLPA. I'll look into that some more, but my first take on it is that they are not reviewing every contract in detail. With as many contracts that get signed in a given season they probably just aren't spending the money on lawyer's fees to review every one with a fine-tooth comb, instead taking the tactic of reviewing contract disputes or irregularities as they happen.

You really haven't heard much from them lately. And they weren't about to start defending Chris Henry and Adam Jones. So they picked this.
